Framework to Access: Stigma-Free Clubs by the Stigma-Free Mental Health Society
Definition: In this agreement, the term “Framework” refers to the Stigma-Free Clubs Framework developed by the Stigma-Free Mental Health Society to help students and educators promote a culture of support and reducing stigma around mental health within their unique school or community environment.
Assumption of Risks: I acknowledge that the implementation of the Stigma-Free Clubs Framework may involve certain risks, dangers, and hazards, including but not limited to:
- - Interactions with individuals experiencing mental health challenges;
- - Emotional and psychological stress related to mental health support;
- - Risks inherent in initiating and managing a group centered around mental health in
- - a school/organization following implementation in the framework;
- - Negligence or misconduct of Stigma-Free Club participants or third parties involved in activities that are conducted as a result of implementing the Stigma-Free Club Framework
I acknowledge and freely accept these risks, fully assuming all responsibility for any personal injury, emotional distress, or other harm that may result from my post-secondary institutions’ implementation in the Stigma-Free Clubs Framework.
Release of Liability and Waiver of Claims: In consideration of being permitted to access the Stigma-Free Clubs Framework from the Stigma-Free Mental Health Society, I hereby agree to waive any and all claims that I have or may have in the future against the Stigma-Free Mental Health Society, its directors, officers, employees, agents, contractors, interns, volunteers, and representatives (hereinafter referred to as the “Organization”) and to release the Organization from any and all liability for any loss, damage, expense, or injury, including but not limited to personal injury, emotional distress, or property damage, that I may suffer as a result of my access or implementation of the framework or my own implementation of a Stigma-Free Club in my post-secondary institution, whether due to negligence, breach of contract, or any other cause.
Indemnity Agreement: I further agree to defend, indemnify, and hold harmless the Stigma-Free Mental Health Society from any claim, demand, or liability, including legal fees, arising out of or related to my accessing and implementation of the Stigma-Free Clubs Framework, including but not limited to the establishment and operation of a Peer Support Group in my post-secondary institution.
Binding Effect: This agreement shall be effective and binding upon me, my heirs, next of kin, executors, administrators, and assigners/assignees.
Governing Law: This agreement shall be governed by and interpreted in accordance with the laws of the provincial or state jurisdiction of the post-secondary institution community in which the Stigma-Free Clubs Framework is implemented.
Acknowledgment: I acknowledge that I have read and understood this agreement and that I am voluntarily agreeing to its terms. I acknowledge that I am of the age of consent within my provincial or state jurisdiction. I understand that by signing this agreement, I am waiving certain legal rights that I or my heirs, next of kin, executors, administrators, and assigns may have against the Organization.
I certify that I will operate the club under the Privacy Provisions of the Province or State of which I work.
